What are the ILR application requirements for a Global Talent visa holder?

The Global Talent visa is a type of UK immigration visa for gifted and bright people who wish to work in the UK and are in specialised disciplines including science, humanities, engineering, the arts, and technology.

This UK visa establishes an immigration category that allows skilled applicants to settle in the UK after three years and potential candidates after five years. Additionally, you could be qualified to submit an application for British citizenship following the completion of your settlement application and the necessary resident duration in the UK.

On February 20, 2020, the Global Talent visa that was announced by the UK government in the 30 January 2020 statement of amendments took effect. The Tier 1 (Exceptional Talent) visa is no longer available for individuals applying after February 20, 2020; however, the Tier 1 Exceptional Talent route is still accessible for ILR applications only. The Tier 1 Exceptional Talent visa, which preceded the Global Talent visa, is somewhat comparable to it. It is often incorrect to describe Global Talent as a new route; rather, it is an enlargement and simplification of existing laws.

ILR- Indefinite Leave to Remain

The Indefinite Leave to Remain (ILR) status exempts the person from UK immigration restrictions and permits them to live and work in the UK indefinitely. This enables people to enter and leave the nation whenever they choose. The major advantage of ILR is that you may reside freely in the UK without worrying about re-entering the country or renewing your visa. Additionally, ILR enables you to utilise the UK's benefits system and waives the immigration health premium required to use the NHS.

Indefinite Leave to Remain (ILR), which is necessary for any foreign person wishing to reside in the UK, can be obtained through a number of visa types. One must have resided in the country for at least five years while in possession of a legitimate UK visa in order to be eligible for ILR. The status is subject to a number of additional conditions, such as proving English language competency and completing the Life in the UK test.

The Global Talent visa's ILR criteria

Three or five years are the qualifying periods.

The Global Talent visa results in settlement/Indefinite Leave to Remain (ILR) in the UK after 3 or 5 years in the category. Whether the candidate received an endorsement under the leader or rising leader criteria, as well as whether the support was given by one of the Science groups, will affect how long the qualifying period is.

The qualifying time is three years for those who satisfy the following requirements:

  • Candidates are recommended for the Exceptional Talent category if they are renowned leaders.
  • Candidates that have received endorsements in science or through the UKRI Endorsed Funder route (whether under Exceptional Talent, or Exceptional Promise).

The qualifying time is five years for those who satisfy the following requirements:

  • Candidates are chosen by Exceptional Promise as "emerging leaders" in either the arts and culture or digital technologies

Time spent on Tire 2 visa and time spent on a Global Talent visa (formerly Tier 1 Exceptional Talent/ Promise) may be added together to reach the appropriate qualifying period. The qualifying duration for family members on Dependent visas is always five years, even if the primary applicant has three years to submit for ILR.

Recommendation for exceptional or promising talent

Holders of the Global Talent (formerly Tier 1 Exceptional Talent/ Promise) visa must confirm that they are still endorsed when submitting an ILR application. Although there is no requirement that they do so, they would have forfeited their visa if the endorsement had been rescinded.

The applicant must demonstrate that since acquiring their Global Talent/Tier 1 Exceptional Talent/Promise visa, they have made money in the UK working in their field of expertise. This often consists of copies of their bank statements and paystubs for the last three months, as well as verification of their job, such as a letter from their company or college. In other instances, proof of self-employment may be needed instead.

When may an ILR request be turned down?

All candidates, including those with Global Talent visas, must have spent no more than 180 days outside the UK in any 12 months throughout the three or five-year qualification period in order to be eligible for ILR. All absences from the UK—whether related to work, family, or vacation—are tallied.

Global Talent/Tier 1 Exceptional Talent/Promise visa holders who were authorised in science or through the UKRI accredited funder scheme are now covered by a new regulation that was previously only applicable to Skilled Worker/Tier 2 visa holders who were working as researchers or lecturers. There is a stricter cap on absences from the UK under the ten-year "Long residency" ILR course.

What conditions must be met to qualify for a global talent visa?

All applicants must receive sponsorship from one of six reputable endorsing groups in order to be permitted entrance into the United Kingdom under the Global Talent visa category.

If you are looking for endorsement in the fields of science, engineering, medicine, social science, the humanities, or other academic professions and research, the Home Office will send your application to the Royal Society, UK Research and Innovation (UKRI), Royal Academy of Engineering, or British Academy. Based on your profile and the supporting documentation you supply, one of these endorsing organisations will decide whether to recommend you.

Your application will be sent to Tech Nation or Arts Council England if you request endorsement in a non-academic field like arts and culture or digital technology.
