Challenging a Paternity Claim: Understanding Your Legal Options

Not all paternity cases are about a father trying to establish his rights. In many cases, a man is served with legal papers claiming he is the father of a child, and he either knows he is not the father or has serious doubts. This is a terrifying and time-sensitive legal situation. Being incorrectly named a legal father carries with it an 18-year financial obligation for child support. This is not a situation to ignore. Firms like JOS FAMILY LAW have the experience to defend clients in these exact situations.

The single most important rule is to never ignore court papers. When you are served with a "Petition to Establish Parental Relationship" (Form FL-200), you have a limited time, usually 30 days, to file a formal "Response" (Form FL-220) with the court. If you fail to respond, the other party can ask the court to enter a "default judgment" against you. This means that, without ever hearing your side of the story or ordering a DNA test, the court can—and likely will—declare you the legal father. You will then be legally responsible for child support, and this is incredibly difficult to undo.

Your formal "Response" is the legal document where you deny paternity and officially request a court-ordered genetic (DNA) test. This is your absolute right, and the court will grant it. It is crucial to understand that a judge will not accept an at-home DNA test that you took yourself. The court will order a legally admissible test from an AABB-accredited lab. At this test, a neutral technician will verify your ID, take your sample, and send the results directly to the court. This "chain of custody" process ensures the results are authentic. If this test comes back with a 0% probability, the court will dismiss the case against you.

The situation becomes far more difficult if you signed a "Voluntary Declaration of Paternity" (VDP) at the hospital. This is a binding legal document. You have a very short and strict window of time (60 days) to "rescind" (cancel) this form. If you miss that window, you are the legal father, period. Your only option is to file a motion to set aside the VDP, which is a complex, uphill, and expensive legal battle. You cannot just ask for a DNA test; you must first prove to a judge that you were a victim of fraud, duress, or a material mistake of fact when you signed it. This is why you should never sign a VDP if you have even the slightest doubt.

Whether you have been served with papers or are trapped by a VDP you regret signing, you need an attorney. This is not a "do-it-yourself" legal problem. For men in this situation, a paternity lawyer in Orange County is not just an advisor; they are a necessary defender. They will ensure your response is filed on time, formally request the DNA test, and protect you from a default judgment.

Challenging a paternity claim is a serious legal matter where every deadline is critical. The key is to act quickly, respond formally, and exercise your right to a genetic test.

If you have been served with paternity papers or need to challenge a paternity claim, contact the professionals at JOS FAMILY LAW immediately.
